The Milwaukee County Sheriff's Office has been posting fliers on Milwaukee's east side warning residents regarding an accused sex offender. Duane Fish is charged with three counts of fourth degree sexual assault for allegedly groping women along Milwaukee's lakefront. Following a court appearance on Wednesday, November 28, 2012, Mr. Fish was released on $500 bail pending another court hearing on December 19, 2012. In response, Milwaukee County Sheriff David Clarke ordered his deputies to post the fliers warning people that Mr. Fish is out on bail. Some have raised concerns that posting the fliers is a violation of Mr. Fish's civil rights. As part of its report on the story, Fox 6 Milwaukee spoke to Samster, Konkel & Safran, S.C. civil rights attorney Jonathan S. Safran, who told the television station that, because the fliers contain public information and state that Mr. Fish has been "accused" of crimes, the fliers likely do not violate Mr. Fish's civil rights. "From a public safety standpoint, I can certainly understand and appreciate the fact that the public should be made aware of it. The only question I would have is why this case, versus many others," Attorney Safran told the station.
